By accessing or using Xclusivefans, you (“User”, “Creator”, “Subscriber”) agree to comply with and be bound by the following Terms of Service (“Terms”). If you do not agree, you must not use the Platform.

 

These Terms apply to all users, including content creators and subscribers.

 

1. DEFINITIONS

• Platform / Service: Xclusivefans website, mobile apps, and all related services.

• User: Any person who creates an account on the platform.

• Creator: A user who uploads and monetizes content.

• Subscriber: A user who pays to access Creator content.

• Content: Any material uploaded, posted, or shared on the platform.

2. ELIGIBILITY

To use Xclusivefans, you must:

1. Be at least 18 years of age OR the legal age of majority in your jurisdiction.

2. Have full legal capacity to enter into this agreement.

3. Not be barred from using digital services under applicable laws.

 

We may request age verification at any time.

3. ACCOUNT REGISTRATION

Users must:

• Provide accurate, complete information.

• Maintain confidentiality of login credentials.

• Be responsible for all activities under their account.

• Notify us immediately of any unauthorized access.

We reserve the right to suspend or close accounts that violate these Terms.
 

4. USE OF THE PLATFORM

Users agree NOT to:

• Upload illegal, harmful, violent, defamatory, or hateful content.

• Upload content that violates copyright or trademark rights.

• Upload pornographic content involving minors or non-consensual acts.

• Harass, impersonate, or defraud another user.

• Attempt to hack, disrupt, or alter the Platform’s functions.

• Circumvent payment systems or share paid content illegally.

Creators are fully responsible for the content they upload and must ensure it complies with all applicable laws.

5. CONTENT OWNERSHIP & LICENSE

5.1. User Ownership
Users retain ownership of all content they upload.

5.2. License to Xclusivefans
By uploading content, you grant Xclusivefans a non-exclusive, worldwide, royalty-free license to:

• Host, store, process, display, and transmit the content on the platform.

We do not own your content and will not sell or distribute it outside the platform without your consent.
 

6. SUBSCRIPTIONS & PAYMENTS

6.1. Subscriber Payments
Subscribers agree to pay applicable subscription fees, tips, or one-time payments. All payments are final and non-refundable, except where required by law.

6.2. Creator Earnings
Creators earn revenue from subscriber payments, after applicable platform service fees.

Creators must:

• Provide accurate payment information.

• Pay applicable taxes in their jurisdiction.

• Comply with AML (Anti–Money Laundering) and KYC (Know Your Customer) checks.

6.3. Chargebacks
Unauthorized chargebacks may lead to:

• Account suspension,

• Reversal of earnings,

• Legal action where applicable.

7. TAXES & COMPLIANCE
Creators are responsible for:

• Declaring income earned from Xclusivefans,

• Paying all applicable taxes,

• Complying with local laws and regulations.

Xclusivefans is not a tax advisor and does not provide tax guidance.

8. INTELLECTUAL PROPERTY RIGHTS
Users must not:

• Copy, download, record, repost, or distribute a Creator’s paid content without permission.

• Upload content they do not own or have rights to use.

Any violation may lead to removal, suspension, or legal action.

9. PROHIBITED CONTENT & CONDUCT
The following are strictly prohibited:

• Child sexual content, exploitation, or endangerment.

• Non-consensual explicit content.

• Revenge porn.

• Incitement to violence or hate speech.

• Drug trafficking or illegal activities.

• Terrorism or extremist content.

• Fraud or circumvention of payment systems.

Violation of any of the above will result in immediate account removal and may be reported to law enforcement.
 

10. TERMINATION OF ACCOUNT
We reserve the right to:

• Suspend or deactivate accounts,

• Remove content,

• Restrict access to certain features,

If the user violates these Terms or applicable laws.

Users may also delete their accounts at any time.

 

11. PRIVACY & DATA PROTECTION
Your privacy is important to us.
We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms.

 

12. DISCLAIMERS

• Xclusivefans does not guarantee uninterrupted or error-free service.

• We do not endorse any user-generated content.

• You use the platform at your own risk.

We provide the service “as is” without warranties expressed or implied.

 

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Xclusivefans shall not be liable for:

• Loss of profits, revenue, or data,

• Indirect, incidental, or consequential damages,

• Actions of users, creators, or third parties,

• Unauthorized access to your account.
 

14. INDEMNIFICATION
Users agree to indemnify and hold Xclusivefans harmless from any claims, damages, losses, or expenses resulting from:

• Their use of the platform,

• Uploaded content,

• Violations of these Terms.

15. MODIFICATIONS TO TERMS

We may update these Terms periodically. Users will be notified of material changes. Continued use of the platform after changes constitutes acceptance.
 

16. GOVERNING LAW
These Terms shall be governed by the laws of the respected Nigeria, United Kingdom, United States].
Any disputes shall be resolved in the court within the jurisdictions.
